Abstract: The objective of this work is to analyze the relevance of maternity within socio affective affiliation and discuss the consequences of its recognition in the Brazilian legal system from the perspective of the child. Due to the social changes made in society over time, Family Law has shown value to the affective bonds existing between parents and children began to recognize a new mode of affiliation, the socio affective, being that affiliation based on family life, solidarity, love between parents and children, without necessarily having a biological or legal bond between them, it is presented in various situations such as homossexual, anaparental, recombined families and among other forms. From the 63rd sentence of the National Council of Justice (CNJ) of November 14, 2017, it provides the recognition of the socioaffective child directly in the Registry Office, that is, regardless of judicial judgment, being a great advance for parents and socioaffective children. The recognition of socio affective affiliation generates personal effects and effects that go beyond the relationship between parents and children, as in the case of the recognition of personality rights, affection-based family life and others. The creation of Law No. 11,924 / 2009 authorized the addition of the name of the stepfather or stepmother family in the birth registration of the stepson or stepdaughter if agreement of the parties occurs, which is a reflection that the socio affective affiliation caused in the legislation. Socio affective maternity has been a direction that has been gradually taken by the rights operators in order to give affection to all existing effectiveness bonds within the family.
It was concluded that the legal doctrine has recognized the new family configurations based on socioaffective relationships, being the basis for decisions regarding the law in this area, based on constitutional principles such as equality, dignity of the human person and right to personality.
