MULTIPARENTALIDADE: OS EFEITOS DA SUCESSÃO APÓS A CONCOMITÂNCIA DAS FILIAÇÕES

Multiparentality emerged in the legal system in 2016, from the general repercussion 622 of the Supreme Federal Court (STF), which recognized the multiparentality institute, after several requests for recognition in registries all over Brazil. With this it is possible to recognize a bond established from the affective relationship, in addition to the biological one. Therefore, the phenomenon of multiparentality allows the minor to have two fathers, two mothers or both in their civil registry. Despite regulations in the field of civil registration, other important legal issues, arising from the recognition of multiparentality, were not properly addressed and created a legal gap, as is the case with succession. With this in mind, the central objective of this research is to discuss the feasibility of double succession in families that fall within the recognized institute. In this sense, Flávio Tartuce (2017 e 2019), as a theoretical reference, demonstrates the departure from any interpretation capable of giving rise to the hierarchy of biological and socio-affective bonds. Based on the literature review methodology, the theoretical research was developed through a hypothetical-deductive scientific method, presenting general concepts and hypotheses. It is concluded with the present work that the son will be the successor of his parents and, these, will be successors of the son, with no hierarchy between biological and socio-affective parents. As a result, it is perceived as a result that the recognition of multiparentality has brought a different type of family to the legal system, but with the same succession procedures as other types of family.
